it's been the wrong folder for a while as well, the x86_64 subdirectory isn't checked and that's where your "illegal ini file" would live
it's also where the OpenComposite configuration ini files will be loaded from as well as other quality of life DLL mods, but those don't matter, any ini must be a pirate!
then there's modern steam emulators that goldberg (not designed for piracy, but can be used for it) that don't *need* an ini file since they can automatically detect the right interfaces to use and store achievements, name etc in appdata
your mod tool should not be actively seeking out pirates (not counting any passive checks like using steam or oculus accounts for login). the game has its own anti piracy checks.
